Faction.Fitness (“Faction”) is operated by Kraken Castle in the United Kingdom. In these terms, “we”, “us”, and “our” mean Kraken Castle.

By creating an account, ticking the acceptance box, or using Faction, you agree to these terms. Our Privacy Policy explains how we handle personal data. You must not use Faction if you do not agree.

You must be at least 18 years old. You must give accurate registration information, keep your login details secure, not share your account, and tell us promptly if you suspect unauthorised access.

Your account is for personal, non-commercial use. Businesses, gyms, coaches, and other commercial users must obtain our written permission by contacting us.

Faction is a casual wellness and entertainment game. It turns steps, distance, activities, and gym sessions into solo progress and friendly quests or weekly tournaments with friends and family.

Faction does not offer gambling, cash prizes, or rewards with monetary value. It is not an official sporting competition and is not intended for professional or high-stakes results.

Faction provides general fitness motivation, not medical, clinical, or professional health advice. You are responsible for deciding whether an activity is suitable for you.

Exercise within your abilities, follow applicable safety guidance, stop if you feel unwell or experience pain, and seek advice from a qualified medical professional where appropriate. Do not disregard professional advice because of anything shown in Faction.

Activity data may come from services such as Garmin Connect, Health Connect by Android, Apple Health, and Samsung Health. You may also record gym sessions while doing them.

Device readings, manual entries, synchronisation, leaderboards, estimates, and progress may be delayed, incomplete, duplicated, or inaccurate. Connected providers are independent of us, and we do not guarantee their accuracy, availability, or continued integration.

We may investigate, correct, disregard, or remove activity and adjust quest or leaderboard results where reasonably necessary to keep the game fair. Our reasonable decision about a friendly-game result is final, but this does not restrict your legal rights.

You control which permitted profile and progress information is visible to friends or others through the available privacy settings. Think carefully before making information visible.

You may ask Faction to send an invitation by email or SMS. Only submit contact details for someone you know and reasonably believe will welcome the invitation. Do not use invitations for spam, harassment, marketing, or commercial promotion.

You retain any rights you have in profile information and content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt for technical purposes, and display it only as needed to operate, secure, improve, and provide Faction according to your settings.

You confirm that you have the rights needed to submit your content. You may end this licence by deleting the content or your account, subject to reasonable technical retention, anonymised game records, backups, and legal requirements described in our Privacy Policy.

Faction’s software, branding, game design, artwork, quests, text, and other service materials are owned by, licensed to, or lawfully used by Kraken Castle. We give you a limited, revocable, non-transferable right to use them personally through Faction.

Some materials are generated or assisted by artificial intelligence. They may contain errors, omissions, or unintended similarities to other material. Report concerns to us and do not treat AI-generated content as medical or other professional advice.

We may introduce optional subscriptions that support Faction and unlock features such as custom games or additional friend games. Free functionality may remain available separately.

Before taking payment, we will clearly show the price, billing period, renewal arrangements, included features, cancellation method, applicable cooling-off rights, and refund terms. Any app-store purchase will also be subject to the store’s applicable terms. We will update these terms before paid subscriptions launch.

Faction may experience outages, bugs, lost progress, or synchronisation failures and is not guaranteed to be continuously available or error-free.

We may maintain, change, pause, or discontinue features, quests, integrations, or the service for security, legal, technical, or product reasons. Where a change materially disadvantages you, we will give reasonable notice where practicable and honour your mandatory consumer rights.

We may restrict, suspend, or disable an account where we reasonably believe these terms have been broken, activity creates risk, or action is needed to protect Faction or others. Serious or urgent misconduct may lead to immediate action. We will act proportionately and, where appropriate, explain the decision.

You may request account deletion through our account deletion page. Information that must remain for legal, security, or game-integrity reasons will be deleted or anonymised so it no longer identifies you, as explained in our Privacy Policy.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

We are not responsible for losses caused by your unsafe activity, inaccurate information you provide, unauthorised account sharing, third-party devices or services, or events outside our reasonable control where we have exercised reasonable care and skill. We are not responsible for business losses because Faction is supplied for personal, non-commercial use.

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, but if you are a consumer living elsewhere, you may also have mandatory rights and may be entitled to bring proceedings in your local courts.

If part of these terms is found unenforceable, the remaining terms will continue. A delay in enforcing a right does not waive it. You may not transfer your agreement with us; we may transfer it as part of a genuine business reorganisation if this does not reduce your rights.
